By using ObituaryCraft (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and ObituaryCraft.
You agree to use the Service to write obituaries, eulogies, and memorials for real people, in good faith. You will not use the Service to harass, defame, impersonate, or harm anyone, or to generate content that violates applicable law.
You will not attempt to reverse engineer the AI, scrape the site at scale, abuse rate limits, or interfere with other users.
You are responsible for any activity that happens under your account email. ObituaryCraft uses magic-link sign-in, so keep access to your email secure. We may suspend or terminate accounts that violate these terms.
You retain ownership of the obituary, eulogy, and memorial text you generate using the Service, including the right to publish it in newspapers, share it at services, and reuse it however you see fit. By using the Service, you grant ObituaryCraft a limited license to store, process, and display that content solely to deliver the Service to you.
We do not use your obituary content to train AI models or for marketing purposes.
Premium ($49.99/year) and Bundle ($59.99/year) are yearly subscriptions, billed in advance through Stripe. The subscription renews automatically each year on the anniversary of your purchase, charged to the payment method you provided, until you cancel. Prices shown on the site are exclusive of VAT; VAT is added at checkout based on your billing country in accordance with EU and Lithuanian tax rules.
You can cancel your subscription at any time from your dashboard or by emailing billing@obituarycraft.com. Cancellation takes effect at the end of the current billing period: you keep access to the paid features until the period ends, and you will not be charged again. We do not pro-rate refunds for unused time in the current period.
Active subscribers retain access to their generated obituary text, eulogy, downloads, AI editor, and (for Bundle) the published memorial site. When a subscription ends, the obituary record is archived and premium features become unavailable; the underlying content is retained per the retention rules in our Privacy Policy so you can re-subscribe and resume.
Right of withdrawal (EU consumers). As a consumer resident in the EU, you have a 14-day right of withdrawal from a distance contract under the Lithuanian Law on Consumer Protection (implementing Directive 2011/83/EU). By starting the AI conversation, unlocking the full obituary, or downloading any generated content during the 14-day period, you expressly request immediate performance of the digital service and acknowledge that you will lose the right of withdrawal once the service has been fully performed. If you have not used the paid features, you may withdraw within 14 days of your first payment by emailing billing@obituarycraft.com and we will refund the most recent charge. Subsequent yearly renewals are not subject to a new 14-day withdrawal period.
Outside the statutory withdrawal window we do not offer refunds for the current billing period. If something has gone seriously wrong — for example, a duplicate charge, a billing error, or a service outage that prevented you from using a paid feature — contact billing@obituarycraft.com and we will resolve it in line with applicable consumer protection law.
The Service generates text using artificial intelligence. AI output can contain errors, including factual mistakes about names, dates, relationships, or events. You are responsible for reviewing the obituary for accuracy before submitting it to a newspaper, funeral home, or memorial service. The AI writes from the information you provide; it does not independently verify facts.
We work to keep the Service available, but we do not guarantee uninterrupted access. Maintenance windows, third- party outages (Stripe, Anthropic, AWS, Neon), and force majeure events may cause temporary unavailability. If a paid feature is unavailable for an extended period, contact support and we will work with you on a fair resolution.
You can stop using the Service at any time. We may suspend or terminate access for violations of these terms or for fraudulent or abusive behavior. On termination, you may request an export of your obituary content within 30 days, after which we may delete it.
To the maximum extent permitted by law, ObituaryCraft is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim related to the Service will not exceed the amount you paid us in the twelve months before the claim arose.
The Service is provided “as is” without warranties of any kind, except those that cannot be excluded under applicable law.
You agree to indemnify ObituaryCraft against claims arising from your misuse of the Service, your violation of these terms, or your violation of any applicable law or third-party right.
These terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-law rules. Disputes will be resolved by the competent courts of the Republic of Lithuania at the seat of ObituaryCraft, except where mandatory consumer protection law in your country of residence gives you the right to bring a claim before the courts of that country.
If you are a consumer resident in the European Union and a dispute cannot be resolved with our support team, you may refer the dispute to the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Consumers in Lithuania may also contact the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba) at vvtat.lt.
We may update these terms from time to time. Material changes will be announced by email to active users and reflected in the “Last updated” date above. Continued use after changes take effect constitutes acceptance.
